Public Space Protection Orders

Public Spaces Protection Orders (PSPO) have been introduced as part of the Anti-social Behaviour, Crime and Policing Act 2014.

PSPOs specify an area where activities are taking place that are or may likely to be detrimental to the local community's quality of life. PSPOs impose conditions or restrictions on people using that area.

Penalty on breach of PSPO 

Any persons found guilty of breaching the order are liable on summary conviction to a fine not exceeding £1,000.

Breaches of a PSPO will result in a Fixed Penalty Notice (FPN) of £100 to be paid within 14 days of being issued. This is discounted to £75 if paid within 7 days.  Failure to pay the FPN will result in prosecution.

PSPOs may be enforced by police officers, police community safety officers and any officers designated by Caerphilly County Borough Council Council.

Public Space Protection Orders (PSPOs) transferred from Designated Public Places Orders (DPPOs)

On 20 October 2017 the existing Designated Public Place Orders (DPPOs) in place in the Caerphilly county borough became Public Space Protection Orders (PSPOs) following the introduction of the Anti Social Behaviour Crime and Policing Act 2014. This transfer occurred automatically and the current Orders will last for a period of three years.

The following conditions apply in the areas listed in the link below:

Areas covered by Public Space Protection Orders (PSPOs)

  1. Not to consume alcohol or anything which the constable or authorised person reasonably believes to be alcohol.

  2. To surrender anything in that person’s possession which is or which the constable or authorised person reasonably believes to be, alcohol or a container for alcohol.

Breaches of a PSPO can be dealt with by the issuing of a £100 Fixed Penalty Notice (FPN) by a Police Officer or Community Safety Warden to anyone he or she believes has committed any offence under the Order.  A person will have 14 days to pay the FPN of £100, or a discounted amount of £75 if paid within 7 days.  Failure to pay the FPN will result in prosecution.

Current DPPO signage advising people that they are in a designated area is currently being updated in line with the new legislation.
